Welcome to PetMemorial. These Terms and Conditions govern access to, use of, and contracting of the services offered through the PetMemorial website, mobile application, and/or any other digital medium operated by PetMemorial.
By accessing, registering, creating an account, using PetMemorial, or purchasing any of its services, you agree to be bound by these Terms and Conditions. If you do not agree with them, you must refrain from using the platform.
PetMemorial is a service operated by Víctor Hugo Pérez Márquez, an individual with domicile in the state of Chihuahua, Mexico.

PetMemorial is a digital platform that allows users to create online memorials for deceased pets, share memories, publish a photograph of the pet, write an epitaph, personalize the tribute, and receive a symbolic letter “from the rainbow.”
The platform may allow each tribute to be configured as public or private, according to the user’s choice when creating or editing it.
Some features may be available for free, on a limited basis, or as a preview, while others may require payment to unlock premium features, full content, or additional customization.
PetMemorial may only be used by adults, in accordance with the applicable laws of their country of residence, especially because payment options are available within the platform.

PetMemorial may reject registrations, suspend accounts, or cancel access when it detects false information, misuse, suspicious activity, breach of these Terms and Conditions, or any risk to the platform, other users, or third parties.

The user retains ownership of their content. However, by publishing, uploading, or generating it on PetMemorial, the user grants PetMemorial a non-exclusive, limited, revocable license necessary to store, reproduce, display, process, technically adapt, and use such content solely for the purpose of operating the platform, providing the contracted service, displaying the tribute according to the selected settings, and maintaining the normal operation of PetMemorial.
PetMemorial may offer the generation of symbolic, emotional, or memorial letters “from the rainbow,” inspired by the information provided by the user about their pet.
The user acknowledges that these letters are intended for symbolic, emotional, and memorial purposes. They do not constitute psychological, medical, therapeutic, spiritual, legal, or professional advice of any kind.
The quality, length, tone, or content of the letter may vary depending on the information provided by the user, the selected language, service availability, and the technological tools used for its generation.
PetMemorial allows certain tributes to be configured as public or private.
The user is responsible for correctly choosing the visibility settings of each tribute. PetMemorial shall not be responsible for access, viewing, or dissemination of content when the user has configured the tribute as public.
When a tribute is public, other users or visitors may view it, share it, or interact with it according to the features available on the platform.

PetMemorial reserves the right, at its sole discretion, to:
The user may request deletion of their account at any time, in accordance with the procedures available on the platform or by contacting the email address indicated above. Account deletion may result in loss of access to content, memorials, letters, customizations, and associated features.
PetMemorial may offer free features, previews, or limited access so that the user can learn about the platform before making a payment.
Some features, such as advanced tribute customization, full access to the symbolic “from the rainbow” letter, premium publication, decorative elements, or any other additional feature, may require payment.
PetMemorial may modify, expand, limit, or remove free or premium features at any time, while seeking to respect the rights acquired by users under the contracted service.
PetMemorial may offer paid services to unlock premium features, such as tribute customization, publication and maintenance of the online memorial, or full access to the symbolic “from the rainbow” letter.
Currently, the contracting model is a one-time payment. This payment does not constitute a subscription and does not generate automatic recurring charges.
PetMemorial will preserve the user’s tribute for a minimum period of 1 (one) year from the date of purchase. However, this period may be extended indefinitely, at no additional cost, provided that the technical, operational, and commercial conditions of the platform allow it.
PetMemorial may make adjustments, improvements, technical migrations, or changes to the way tributes are hosted, displayed, or preserved, while seeking to keep the contracted content available during the minimum period indicated above.
Once the minimum preservation period has concluded, PetMemorial may offer extension, reactivation, renewal, continuity options, or new contracting models, when such options are available.
PetMemorial services do not include automatic renewal.
Any extension, reactivation, renewal, or new purchase must be made through a new payment, when such option is available.
The user will not receive automatic recurring charges from PetMemorial related to the maintenance of the tribute, unless a different model is offered in the future and the user expressly accepts it.
Payments in PetMemorial are processed by authorized third parties, depending on the channel used by the user:
PetMemorial does not store banking data or complete credit or debit card information on its own servers.
The user accepts that payment processing, purchase confirmation, and, where applicable, any refund request are also subject to the terms, conditions, timelines, validations, and policies of the corresponding payment provider.
PetMemorial may record purchase-related information, such as transaction identifiers, payment status, purchased product, purchase channel, date, currency, amount, payment provider, and technical data necessary to validate the operation and grant the corresponding access.
PetMemorial may evaluate refund requests on a case-by-case basis, in accordance with its internal policies, applicable law, and the rules of the payment provider used.
When payment is processed by third parties, such as Google Play, Apple / App Store, or PayPal, the refund process may additionally depend on the rules, timelines, validations, and policies of those platforms.
PetMemorial cannot guarantee approval of refunds when the final decision belongs to the external payment provider.
In the event of a refund, cancellation, chargeback, or payment reversal, PetMemorial may suspend, limit, or remove access to the premium features associated with the corresponding purchase.
PetMemorial may use analytics, measurement, attribution, and event tracking tools to understand platform usage, improve the user experience, measure the performance of its advertising campaigns, and optimize its services.
These tools may record events related to the use of the platform, such as screen views, registration start and completion, tribute creation, preview views, interaction with unlock buttons, purchase process initiation, purchase confirmation, or other relevant actions within the platform.
This information may be used for operational, statistical, advertising, attribution, diagnostic, fraud prevention, service improvement, and campaign performance measurement purposes on platforms such as Meta, Google, Firebase, or other similar providers.
The processing of this information is carried out in accordance with the PetMemorial Privacy Policy, which forms a complementary part of these Terms and Conditions.
All rights to the PetMemorial platform, including but not limited to:
are owned by Víctor Hugo Pérez Márquez and/or their respective licensors, and are protected by applicable intellectual property laws.
Their reproduction, distribution, modification, public communication, reverse engineering, copying, extraction, unauthorized exploitation, or any use not expressly permitted by PetMemorial is prohibited.
PetMemorial is offered on an “as is” and “as available” basis.
PetMemorial does not guarantee that:
PetMemorial may carry out updates, improvements, maintenance, temporary suspensions, migrations, technical adjustments, or functional changes at any time, with or without prior notice, when necessary.

The user acknowledges that they use the platform under their own responsibility.
PetMemorial may integrate with third-party services to operate properly, including payment processors, app stores, analytics services, attribution services, advertising services, hosting providers, notification systems, email services, diagnostic tools, and other technology providers.
The use of such services may be subject to the terms, conditions, and privacy policies of each provider. PetMemorial does not control and is not responsible for the decisions, policies, availability, or operation of such external services.
The processing of personal data is governed by the PetMemorial Privacy Policy, which forms a complementary part of these Terms and Conditions.
By using PetMemorial, the user acknowledges having read and accepted such Privacy Policy.
The Privacy Policy explains in greater detail what information may be collected, for what purposes it is used, how it is protected, with whom it may be shared, and what rights the user may exercise regarding their personal data.
PetMemorial may modify these Terms and Conditions at any time to reflect legal, operational, technical, commercial, product, payment, analytics, or platform functionality changes.
When changes are relevant, users will be notified through reasonable means, such as the app, website, email, or any other available method.
When necessary, PetMemorial may request that the user expressly accept a new version of these Terms and Conditions in order to continue using the platform.
Continued use of the platform after the effective date of the changes shall imply acceptance of the updated version, unless applicable law requires additional consent.
PetMemorial may terminate, suspend, or limit the user’s access to the service immediately when:

These Terms and Conditions are governed by the applicable laws of Mexico, particularly the provisions applicable in the State of Chihuahua.
For any dispute arising from the interpretation, performance, or enforcement of these Terms and Conditions, the parties submit to the jurisdiction of the competent courts of the City of Chihuahua, Chihuahua, waiving any other jurisdiction that may correspond to them due to their present or future domicile.
